1. Agreement to terms
By accessing or using the San Bernardino Wildfire Defense website ("the Site"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.
2. Service description
The Site is a lead-generation and information platform that connects homeowners with vetted, licensed wildfire mitigation contractors operating in San Bernardino County, California. We do not perform wildfire mitigation, defensible space, tree work, landscaping, or any other field services directly. All work is performed by independent contractors that you choose to engage.
3. No contractor-client relationship
Submitting a request through the Site does not create a contractor-client, agency, employment, partnership, or fiduciary relationship between you and San Bernardino Wildfire Defense. Any service contract, scope of work, payment, scheduling, warranty, or other agreement is solely between you and the contractor you engage.
4. No warranty on contractor work
We make reasonable efforts to vet contractors in our network, including verifying California state licensing and insurance information at the time of onboarding. However, we do not guarantee, warranty, or assume responsibility for the quality, timeliness, safety, pricing, or outcome of any contractor's work. Disputes about contractor performance, billing, or warranty must be resolved directly with the contractor.

Content on the Site — including descriptions of CAL FIRE Public Resources Code 4291, San Bernardino County Code 23.0301–23.0319, AB 3074 Zone 0, AB 38, and related programs — is provided for general informational purposes only and is not legal advice. Specific regulatory requirements, deadlines, exemptions, and enforcement actions should always be verified with the applicable authority, including CAL FIRE, the San Bernardino County Fire Protection District, your local fire jurisdiction, and your insurance carrier.

5c. Service and compliance outcomes
Connecting with a contractor through this Site does not guarantee:
- Regulatory compliance approval.
- Insurance carrier acceptance of completed work.
- Specific timelines for service completion.
- Specific outcomes from CAL FIRE inspections, county inspections, or insurance reviews.
- Specific cost outcomes.
Each property and situation is unique. Compliance outcomes depend on factors outside this Site's control.
6. User responsibilities
By using the Site, you agree to:

8a. Limitation of liability for regulatory information
To the maximum extent permitted by California law, San Bernardino Wildfire Defense and its operators, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

You agree to indemnify, defend, and hold harmless San Bernardino Wildfire Defense and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your interactions with any contractor engaged through the Site.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site shall be resolved in the state or federal courts located in San Bernardino County, California.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
